Terms of Service
Effective date: 8 September 2026 Last updated: 8 September 2026
These Terms of Service ("Terms") are a legally binding agreement between you and RL Apex LLP, a Limited Liability Partnership (LLP), with its registered office at Flat No. 'A' - 802, Sr No. 292/6/1/2/3/5/7, Pride Valencia, Dhankude Wasti, Pune, Maharashtra, 411045 ("GROWTH", "we", "us", "our"). They govern your access to and use of the GROWTH website, applications, and services (together, the "Service").
By creating an account, ticking the acceptance box, or using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract under the Indian Contract Act, 1872. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" refers to that organisation.
2. Your account
- You register with a mobile number (verified by one-time password sent over WhatsApp) and/or an email address and password. You may optionally set a 6-digit PIN or register a passkey for faster sign-in on devices you have already verified.
- You are responsible for keeping your credentials, PIN, and devices secure and for all activity under your account. Tell us at systems@rlapex.com promptly if you suspect unauthorised use.
- You must give accurate, current information and keep it updated. We may suspend or terminate accounts that contain false information or are used to impersonate others.
- One person, one account, unless we agree otherwise in writing.
3. Access tiers, trial, and approval
- New members may receive a 7-day free trial covering goals, habits, and daily practices, plus any live sessions or courses an administrator has marked as available during the trial. Trial scope may change at our discretion.
- Full access to the community, the full course library, and all live sessions requires either administrator approval (a free grant, at our discretion) or an active paid subscription.
- When a trial ends without approval or a subscription, features added during the trial become read-only or locked. Your data is retained per the Privacy Policy.
4. Payments, subscriptions, and taxes
- Paid plans and course purchases are processed by our payment partner Razorpay. We do not store your full card or bank details.
- Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You authorise us and Razorpay to charge your saved payment method for each renewal.
- Prices are shown at https://our-growth-2026.vercel.app/upgrade and are inclusive or exclusive of GST as stated there. We issue a tax invoice for each successful payment; you can download it from your account.
- We may change prices with at least 30 days' notice before your next renewal. Continuing after the change takes effect means you accept the new price.
- Refunds and cancellations are governed by the Refund & Cancellation Policy.
5. Acceptable use
You agree not to:
- break the law, infringe anyone's rights, or help anyone else do so;
- post or share content that is abusive, harassing, hateful, defamatory, obscene, misleading, or that violates someone's privacy or intellectual property;
- upload identity documents or personal data that are not your own or that you are not authorised to share;
- share, resell, record, redistribute, or publicly perform course videos, live sessions, PDFs, or other paid materials, or circumvent access controls;
- scrape, crawl, or bulk-download the Service, or use bots except as we expressly allow;
- probe, scan, or test the vulnerability of the Service, or breach its security or authentication measures;
- interfere with the Service's operation, overload our infrastructure, or introduce malware;
- use the Service to send spam or unsolicited messages to other members.
We may remove content and suspend or terminate accounts that breach this section, with or without notice depending on severity.
6. Member content and the community
- You keep ownership of the content you post (posts, comments, check-in notes, affirmations you write, wins you share). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely to operate and improve the Service and to show it to the audience you chose (for example, other members in the community).
- You are responsible for your content and confirm you have the rights to post it.
- We may, but are not obliged to, moderate content. We may remove or restrict content that breaches these Terms or that we reasonably believe creates legal risk.
- Reporting: use the in-app report tools for content that breaches these Terms.
7. Our intellectual property
The Service, including its software, design, text, graphics, course materials, and recordings, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service and to access purchased or granted materials for your own personal development. No other rights are granted.
8. Third-party services and links
- Live sessions are held on third-party platforms (e.g. video-meeting providers). Your use of those platforms is subject to their own terms and privacy policies.
- Google Calendar: if you connect it, we read and write only that week's goal tasks, habits, and session RSVPs, as described in the app and the Privacy Policy. You can disconnect at any time.
- We are not responsible for third-party services, their availability, or their content.
9. Availability, changes, and beta features
- We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and features may change, be added, or be removed.
- Some features may be labelled beta or preview and may be changed or withdrawn without notice.
10. Suspension and termination
- You may stop using the Service at any time and may delete your account from the app.
- We may suspend or terminate your access, immediately and without refund, if you materially breach these Terms, create risk or legal exposure for us or other members, or if required by law. For less serious issues we will usually give notice and a chance to fix the problem.
- On termination: your right to use the Service ends; sections that by their nature should survive (payments owed, IP, disclaimers, limitation of liability, indemnity, governing law) continue. Data handling on termination is covered by the Privacy Policy.
11. Disclaimers
- GROWTH provides personal-development tools, education, and community. It does not provide medical, psychological, financial, legal, or other professional advice, and nothing on the Service is a substitute for a qualified professional. Decisions you make based on the Service are your own responsibility. If you are in crisis or need clinical help, contact a qualified professional or emergency services.
- The Service and all content are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any particular result, outcome, or benefit from using the Service.
12. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or opportunity, arising out of or relating to the Service.
- Our total aggregate liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, or (b) INR 5,000.
- Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, for death or personal injury caused by negligence, or for fraud).
13. Indemnity
You will indemnify and hold us and our officers, employees, and agents harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of applicable law.
14. Changes to these Terms
We may update these Terms. If a change is material, we will give reasonable notice (for example, by email, in-app notice, or by requiring re-acceptance) before it takes effect. Continuing to use the Service after that means you accept the updated Terms. Each version carries a version number and date.
15. Governing law and disputes
These Terms are governed by the laws of India. Subject to any right you have under consumer-protection law to bring proceedings elsewhere, the courts at Pune, Maharashtra have exclusive jurisdiction. The parties will first try in good faith to resolve any dispute informally by contacting systems@rlapex.com.
